Dieser Bestandsschutz ist in einem Rundfunkstaatsvertrag geregelt. Mitte der 80er Jahre entstanden in Deutschland private Rundfunkprogramme und das 'duale System' nahm seinen Anfang. Schnell klarten sich die Fronten: offentlich-rechtlich steht fur Bildung, Information, Kultur und gehobene Unterhaltung. Die privaten Rundfunkprogramme stehen fur den Verfall derselben, also das genaue Gegenteil. Ihr Massstab - die Quote - verlangt nach immer extremeren, Grenzen verschiebenden Formaten, die schon lange nicht mehr mit dem offentlich-rechtlichen Anspruch vereinbar sind. Fatalerweise ist im Laufe der Kommerzialisierung der westlichen Welt der Massstab des eigenen oder selbst auferlegten Anspruchs weitgehend abgelost worden, von dem rein monetaren Interesse der Quote.
