The Internationalisation of Legal Education

Author: Christophe Jamin
Publisher: Springer
ISBN: 9783319291253
Release Date: 2016-04-30
Genre: Law

This volume provides an overview of the state of internationalisation of legal education (IOLE) in many civil law and common law countries. It provides a picture of the status of the debate about the shape and degree of internationalisation in the curriculum in the different countries, and the debates surrounding the adoption of a more international approach to legal education in the contemporary world. It is a compilation of the National Reports submitted for the August 2014 Congress of the IACL held at Vienna, and contains an introductory general report. Together, the reports examine such questions as: Why is the topic of internationalization of legal education on the agenda now? Why is it a relevant subject for examination today? Does the topic generate the same level of interest everywhere in the world? Is enthusiasm for IOLE mainly driven by the academic sector, by government, by multinational corporations? Is the interest closely linked with the globalization of the practice of law? Or is globalisation of law itself something of a myth, or a reality reserved for only a very small percentage of practising lawyers around the world? The general and national reports make clear that there is indeed widespread interest in IOLE, and numerous disparate initiatives around the world. Nonetheless, some National Reporters state that the topic is simply not on the agenda at all. All in all, the volume shows that the approaches to internationalisation are many and varied, but every jurisdiction recognises the importance of introducing aspiring lawyers to a more integrated global environment.

6 D sseldorfer Verkehrsrechtsforum

Author: Dirk Looschelders
Publisher: VVW GmbH
ISBN: 9783862984299
Release Date: 2017
Genre: Business & Economics

Law and Custom in Korea

Author: Marie Seong-Hak Kim
Publisher: Cambridge University Press
ISBN: 9781139536349
Release Date: 2012-08-27
Genre: History

This book sets forth the evolution of Korea's law and legal system from the Chosǒn dynasty through the colonial and postcolonial modern periods. This is the first book in English that comprehensively studies Korean legal history in comparison with European legal history, with particular emphasis on customary law. Korea's passage to Romano-German civil law under Japanese rule marked a drastic departure from its indigenous legal tradition. The transplantation of modern civil law in Korea was facilitated by Japanese colonial jurists who created a Korean customary law; this constructed customary law served as an intermediary regime between tradition and the demands of modern law. The transformation of Korean law by the forces of Westernisation points to new interpretations of colonial history and presents an intriguing case for investigating the spread of law on a global level. In-depth discussions of French customary law and Japanese legal history also provide a solid conceptual framework suitable for comparing European and East Asian legal traditions.

Beyond the State

Author: Nils Jansen
Publisher: Mohr Siebrek Ek
ISBN: 3161498623
Release Date: 2008
Genre: Law

Private law beyond the state is a topic that is fashionable, important, and widely discussed. Yet it presents so many different aspects and perspectives that it has, so far, remained remarkably poorly understood. Precisely because globalization moves the law beyond the state, lawyers find themselves forced to rethink private law and its relation to the state. This volume brings together contributions of leading scholars from the United States, Israel and Germany exploring the topic from different perspectives: legal history, law and economics, legal sociology, private international law, and law and anthropology. They aim at clarifying and structuring current debates, focussing on the historical, conceptual, and epistemological relations between private law and the state as well as on their relevance for legal argument; on the actors involved in processes connecting and dividing private law and the state; and on the fundamental normative questions that result from these processes.

Employee Participation and Collective Bargaining in Europe and China

Author: Jürgen Basedow
Publisher:
ISBN: 3161544064
Release Date: 2016-01-01
Genre: Collective bargaining

Collective labour law is, for the most part, national law. It is often the result of social struggle and political compromise occurring in the national context. Unlike other fields of private law, it has not been the object of legal harmonisation, at either international or European levels. However, as national frontiers progressively open up for goods and services, collective labour law has become increasingly exposed to international and supranational law. This book contains the papers presented at an international conference held at the Max Planck Institute for Comparative and International Private Law in 2014. The authors look, from a comparative perspective, at current developments in the fields of collective bargaining and employee participation in several European countries and in China. They analyse the extent to which differences between the national legal systems still prevail and whether common features are about to emerge. With contributions byChen Su, Örjan Edström, Matteo Fornasier, Robbert H. van het Kaar, Li Jianfei, Ulla Liukkunen, Louise Merrett, Etienne Pataut, Achim Seifert, Bernd Waas, Xie Zengyi, Zhang Hui
